VII) Loss of Backup and Data :-

Usage of our services is at your own solitary risk. Weblink.In or any platform of Weblink .In Pvt. Ltd. is not accountable for any data and/or files domiciling on your account. You agree to be responsible for Data transfer, files and maintenance of proper backup of data and files put up on Host Gator servers. We are entitled to take weekly backups of data which have been changed or are new. These backups serve the purpose of server restoration. The clients/ users are solely responsible for taking the backup of the files owned by them.

CGI SCRIPTS Sharing of scripts with the domains which are not hosted by Weblink .In Pvt. Ltd. is not allowed. Whichever CGI-scripts supposed to be negatively disturbing performance of our server or network integrity would be subjected to be closed immediately, without prior notice. Use of CGI, has to be followed by a written permission from Weblink .In Pvt. Ltd.

VIII) Intellectual Property Rights :-

The Site/Company is the sole owner of all the rights to the Site and the Site Content. All title, ownership and intellectual property rights in the Site and Site Content shall remain with the Site/Company, its affiliates or licensors of the Site Content, as the case may be. All rights not otherwise claimed under this Agreement or by the Site are hereby reserved.

Logo, icons and trademarks and services marks put on view on this website are solely owned by the Company or its licensor/ User and any personal or commercial use of the same is strictly prohibited. The unauthorized modification, copy, use or publication of the website may give rise to the claim for damages and legal action.

The User or Member of Weblink.in or any platform of Weblink .In Pvt. Ltd. grants exclusive license to Weblink .In Pvt. Ltd. to use, advertise its Logo, Icon,, Trademark, Service mark, details etc. If any user/ member has any issue or do not allow the same shall contact the Grievance Officer to register their request for the same.

Payment for memberships:

All payments for services at various portals owned and managed by Weblink .In Pvt. Ltd. have to be made in favour of "Weblink .IN Pvt. Ltd." only. All payments need to be made on 100% advance basis to continue to use uninterrupted Paid Services.

We have not authorized any individual or organization to collect payments in any other name (i.e. any other individual or organization name) or via personal Western Union or personal Paypal Accounts for any services rendered by Weblink .IN. You are informed that under no circumstances will Weblink .IN be liable for any damage caused due to your transactions/ payments made to/ in favor of such fraudulent individuals or organizations. To protect your interests, you shall contact on our customer care number. Further, please contact us immediately if any such fraudulent individual or organization tries to mislead you.

The User, who is liable to pay Subscription Fees, shall pay it on demand even if the User disputes the same for any reason. In the event that the Company deciding the dispute to be in the User's favor, the Company shall refund to the User any excess amount paid by the Member free of interest. In the event of late payment by the User of any sums due under this Agreement, the Membership and the services would stand terminated.

XI) Refund/Return Policy:

Refund / Money Back Policy:

Once subscribed, the payment made by the User for Paid service is not refundable and no claim for refund would be entertained. Weblink .IN neither offers any guarantees for the accuracy, timeliness, authenticity nor advocates any of the content posted by the other Users. All the services are on a best effort basis.

Refund on the basis of fraudulent transactions

The User is solely responsible for maintaining confidentiality, as well as all the activities and transmission performed through him. He/she shall be solely responsible for carrying out any online or off-line transaction involving credit cards / debit cards or such other forms of instruments or documents for making such transactions. Weblink .IN assumes no responsibility or liability for their improper use of information relating to such usage of credit cards / debit cards used by the subscriber online / off-line.

Refund on the basis of change in preference / delay in process

As we at Weblink .IN keep up high interactions with our clients and carry out the entire process with their approval thus there is no provision for any kind of full or partial refund.

Once an order is placed it cannot be cancelled as it is sent for processing immediately. Your personal preferences changed in the course of time, cannot serve a reason for refund or charge back.

XII) Limitation of Liability :

Ltd., its Office bearers, associates, employees or any third party authorized representatives, shall under no circumstances be held liable or responsible to any user or member or his/her authorized Representative or Registrant or any third party for any direct, indirect, special, exemplary, incidental, or consequential damages of any character including, damages resulting from the use of any of our Website/ App/ services.
Notwithstanding anything to the contrary contained herein, Weblink's liability to you for any cause whatsoever, and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to Weblink.In or any of Weblink .In Pvt. Ltd. platforms, for any specific paid package, and no further.
WEBLINK.IN PVT. LTD. or any of its platform or its office bearers shall under no circumstances be liable, if any, for the user/ member entering into financial transaction with any other user/ member interacted through its platform or any third party.

XIII) Indemnity :

By using our services you agree to defend, indemnify, and hold harmless Weblink.In and/or Weblink .In Pvt. Ltd., its subsidiaries, affiliates, Directors, officers, agents, and other partners and employees, fully indemnified and harmless from any loss, damage, liability, claim, or demand, including reasonable attorney's fees, made by any person through improper use of the service. This defense and indemnification obligation will survive in perpetuity.
Weblink's Right to Defend: Weblink .In Pvt. Ltd. reserves the right, at its sole discretion, to defend itself against any and all claims, demands, lawsuits, or other legal proceedings (collectively, "Legal Actions") arising out of, or relating to, your use of the Services or your violation of this Agreement. Weblink .In Pvt. Ltd. shall have the right to choose its own legal counsel and control the defense of any such Legal Action. You agree to cooperate fully with Weblink .In Pvt. Ltd. in connection with any Legal Action, including providing all relevant information and documentation requested by Weblink .In Pvt. Ltd.
User's Responsibility for Costs: You agree to reimburse Weblink .In Pvt. Ltd. for all reasonable costs and expenses, including attorney's fees, court costs, and other litigation expenses, incurred by Weblink .In Pvt. Ltd. in connection with any Legal Action arising out of, or relating to, your use of the Services or your violation of this Agreement. Weblink .In Pvt. Ltd. shall provide you with a reasonable opportunity to cure any alleged violation before incurring significant legal fees. However, you remain obligated to reimburse Weblink .In Pvt. Ltd. for all reasonable costs and expenses incurred, even if the Legal Action is ultimately resolved in your favor.
Reservation of Rights: Weblink .In Pvt. Ltd. right to defend itself and seek reimbursement under this Clause is without prejudice to any other remedies available to Weblink .In Pvt. Ltd. under this Agreement or at law.

XIV) Matter of disputes, Jurisdiction and Resolution Aspects

Compliance With Law

Each User or member shall be individually responsible for ensuring compliance by them with all relevant laws or legal obligations which includes all the laws in force in their local jurisdiction in addition to laws applicable at New Delhi, India.

Severability

If any provision of these Terms & Conditions, Privacy Policy, or Disclaimer is found to be illegal or unenforceable, such provision shall be severed from the remainder of the agreement without affecting the validity or enforceability of remaining provisions. The remaining provisions shall survive and continue in full force and effect.

Mediation & Arbitration

All disputes and differences of any kind whatsoever arising out of or in connection with any of terms or clause or actions of any user or whatsoever that is not resolved shall be referred mandatorily to Mediation first. Any and all disputes, controversies and conflicts ("Disputes") arising out any dispute against Weblink.In or Weblink .In Pvt. Ltd. or including Weblink.In or Weblink .In Pvt. Ltd. shall be referred for arbitration in terms of the Arbitration and Conciliation Act, 1996 (Arbitration Act) or any amendments thereof. Prior to submitting the Disputes to arbitration the parties shall make all endeavors to settle the dispute/s through mutual negotiation and discussions. In the event that the said dispute/s are not settled within 30 days of the arising thereof as evidenced through the first written communication from any party notifying the other regarding the disputes, the same shall finally be settled and determined by arbitration. The ARBITRATION AND MEDIATION shall be held at New Delhi and the proceedings shall be held in English.

Governing Law and Jurisdiction

Any dispute shall be governed and construed in accordance with the Laws of Union of India applicable at New Delhi, India. Further, the Parties/ User/ Member agree to submit to the exclusive jurisdiction of the appropriate court in New Delhi in connection with any dispute between the Parties whatsoever.

Amendments/Modifications

Any or All Amendments to Terms & Conditions, Privacy Policy, and Disclaimer: We reserve the right to modify these Terms & Conditions, Privacy Policy, and Disclaimer at any time. We will use reasonable efforts to notify you of any changes by posting the said amended Terms & Conditions or Privacy Policy, or Disclaimer on our website. The revised agreements will be effective upon posting and deemed to be notified upon posting on its website.
